Language and law : language use in professional legal parlance.

A large proportion of hospital inpatients are affected by cognitive impairment, posing challenges in the provision of their care in busy, fast-paced acute wards. Signs and symbols, known as visual identifiers, are employed in many U.K. hospitals with the intention of helping healthcare professionals identify and respond to the needs of these patients. Although widely considered useful, these tools are used inconsistently, have not been subject to full evaluation, and attract criticism for acting as a shorthand for a routinized response. (...) In order for visual identifiers to be used effectively in acute care settings, thorough consideration must be given to the ethical and legal issues that are engaged in this context, and their potential benefits and harms must be weighed and balanced. This paper proposes a set of legal and ethical principles that can be used to guide the implementation of visual identifiers. Together, these principles provide a framework applicable in the design and implementation phases to systematically identify relevant considerations arising from the use of these tools. We outline some tensions that arise between principles and conclude that selecting a preferred moral framework could help to guide decision-making, as does clarity around the purpose and objectives of the identifier. _Purpose._ The paper attempts to investigate the constructivist approach to the social world and its implications for social forecasting. _Theoretical basis._ Social forecasting is mainly based on the idea that a human is "determined ontologically". Using the methodology of the natural sciences, most predictions and forecasts fail to encompass all the multiplicity and variability of the future. The postmodern interpretation of reality gave impetus to the development of the new approaches to it. A constructivist approach to social reality began to (...) compete with essentialism. Social constructivism asserts that reality is a set of mental constructs, that it is ultimately a text. Radical constructivism interprets reality as a specific system of meanings emphasizing the artifact aspects of our reality. An interpretation of the social actors’ behavior is based on the ways of understanding accepted in a given society/community and do not possess ontological universality. The creators of social space are also its creations. _Originality._ Within the framework of the postmodern approach to reality, the second-order forecasting, or forecasting of forecasting, is particularly relevant. That means that the observers-forecasters must be included in the forecast as a part of one-unified process. At this stage, a forecaster must realize that he/she is a part of a larger system, a part of the world he/she observes (and actually creates). The situation changes dramatically – the forecaster is forced to take responsibility for his/her own observations. This ultimately leads to the "humanization" of forecasting. Acting in our world full of uncertainty, unpredictability, and turbulence, modern researchers of the future should be mindful of powerful social constructs of reality. _Conclusions._ Social forecasting should be embedded in a wider context, which requires a joint effort of philosophers, foresight practitioners, historians, psychologists, sociologists, political scientists, religious scholars, anthropologists, etc. To develop promising visions and scenarios of the future, it is necessary to answer the question "Why?", which is the task of philosophically oriented research, because without this answer, we will deal with the consequences; and the implementation of the negative scenarios will reproduce itself in new socio-cultural and historical conditions. An in-depth understanding of this "Why?" provides opportunities to be in the flow of transformations. The study of the deep mental processes of the actors of social changes, the multidimensional influence on the transformation of social structures can gradually expand an answer to the question "Why?", that can cause positive changes and, accordingly, allow to create fruitful projects of the future and form effective behavioral strategies that correspond to the desired level of social development. Resumo: Neste texto, introduzo algumas questões importantes que fazem parte do debate sobre infiltração pragmática. Além de apresentar e problematizar as principais alegações oferecidas pelos proponentes da infiltração pragmática eu irei contrasta-la com algumas teses mais tradicionais, como a Tese Tradicional sobre o Conhecimento e o Contextualismo Epistêmico. Por fim, apresento uma crítica aos proponentes da infiltração pragmática que parece ainda não ter sido tratada. Concluo que embora controversa, tal tese está longe de ser refutada completamente. After introducing and discussing the main arguments offered by the pragmatic encroachers advocates I will contrast it with more traditional theses such as the Traditional Analysis of Knowledge and Epistemic Contextualism. Finally, I present an objection to the pragmatic encroachment approach that haven't been treated yet. The urgency of the paper is to explore the impact of the latest discoveries of the exact and human sciences on the activities of higher education in its ideological perspective. There is a tendency to increasing interest of medical students not only in professional issues, but also in the general atmosphere of changes in health care and the requirements already formulated by the society of the future. The purpose of the article is to continue our study of the historical and (...) philosophical evolution of humanistic ideas and views from the ideas of the times of Antiquity up to modern theories and futuristic predictions. The problem of the study is to analyze the phenomenon of transhumanism as the result of unrealistic expectations about the easy implementation of most people's dreams of health, happiness and even immortality. The prospects of development of means and methods of "artificial intelligence" are also studied. The research methods consist of combining the achievements of classical philosophy with the successes of the youngest sciences that study human beings, operate large data, use foresight and other means of forecasting. The central new notions are noosciences and nootechnologies, which are able to save mankind from the threats to its existence. Results of the research : a philosophical analysis of the new worldview – transhumanism has been undertaken in the article. The reasons for its appearance in the second half of the twentieth century are explained. The social and scientific sources and the main stages of the consolidation of supporters of transhumanism in the world and national associations have been studied. The variety of proposals of transhumanists and their relative unity as to the need for "human perfection" have been also studied. The main variants of "Transhumanistic manifestos " have been analyzed and showed the existence of two flows of proposals - technological and those oriented on changes in human behavior. It is proved that in our time transhumanism is an option of fundraising - the collection of donations from the very rich people who strive to live longer than it is possible now. It is indicated that transhumanism is supported by the male segment of the citizens of the West, who are keen on technological progress and, above all, fear of death. The position of T-m is positive for medical research. The conclusion s of our study showed the fact that existing variants of transhumanistic studies use only a minority of modern and promising technologies. Even leading scientists from Western Europe do not notice that among the nanotechnologies, the number of environmentally friendly nootechnologies is slowly growing. A group of scholars are studying these technologies and offering an increasing number of noosciences. We have chosen for our study the notion of "noohumanism". The article proves that in worldview and educational aspects noohumanism based on the noosciences has not only significant creative advantages over transhumanism, but is also devoid of its shortcomings. Medical and other sectors of higher education in Ukraine should rely on noohumanism, not transhumanism. (shrink)

_Purpose._ This paper aims to investigate the phenomenon of a human being within the Confucian tradition as well as its interpretations from intercultural perspective. _Theoretical basis._ One of the ways to understand the deepest level of the intercultural dialogue is to reveal the interpretations of a human being in philosophical traditions, since they refer to the formation of personality and identity within a given culture including interpersonal, intergroup, and intercultural relations. Humanism based on the unity of Human and Heaven runs (...) like a red thread through the philosophical teachings of Confucius, Mencius, Xunzi, Zhu Xi, Wang Yangming defining the ideas of human nature, his/her duties, his/her place and roles in society that shaped the Chinese mentality. _Originality._ Quite often, Chinese concepts (for example, human dignity beyond the ideas of democracy and mass political participation, guanxi, mianzi) are incomprehensible to the representatives of the Western civilization, which leads to the challenges in intercultural communication. The interpretation of these ideas in the context of Confucianism allows to understand them from the perspective of Others and expand the set of patterns of cultural perception. This ultimately leads to the awareness that there are many social, political, cultural realities, which we perceive through the lens of our own concepts and attitudes. The participants of an intercultural dialogue realize that each of them has a unique experience, own way of posing a problem and resolving it, and no one is better or worse. _Conclusions._ Confucian philosophy shaped the worldview of Chinese people, defined values, goals, meanings, attitudes, communication models, which affected all spheres of Chinese life and culture. The study of the philosophical heritage of the great Chinese civilization enhances the cultural competence of the intercultural communicators and expands the field of dialogue to the level of global communication. In this paper, a survey of 180 inscriptions in Tamil between 1346 CE and 1400 CE is analysed for its notions and visualization of astral themes present in the epigraphical inscriptions as well as for the calendrical practices implicit in those inscriptions. I demonstrate the rich diversity of calendrical practices employed in this period. Although there are clear local usages, the applied methods of identification show that in several cases methods from other Indian calendrical traditions have also been used. This (...) applies both to the year and the month. In contrast, the use of the weekday is not widely seen in the inscriptions of this region following the local system. The study also clarifies that the inscriptions are a useful documentary source for other astronomical observations such as eclipses and solstices undertaken in southern Indian locations in the fourteenth and fifteenth centuries. In Russia, philosophy of religion, likewise religious studies, only managed to claim their name, let alone their right for self-realisation, as late as the early 1990s. The article represents an attempt to elicit the maximum possible number of primary methodological accounts, conceptual divergences and discussions pertaining to both the domain of understanding and that of studying the phenomenon of religion and the variety of religious expression, as well as methods of establishing the actual interdisciplinary relations between religious studies and the (...) philosophy of religion, with their disciplinary scope defined, on the one hand, and contiguous scientific disciplines and worldview discourses on the other. Two levels can be distinguished in the structure of a language as a system of signs: the level of expression and the level of contents. Every sign of a language will thus be characterized by the unity of these two aspects. We can distinguish therein the signifying (.signans) and the signified (signatum), which correspond to the two levels of the language. Relations between the signifying and the signified in linguistic signs are determined by the relationship between their content and their (...) expression. Relations between signs at the level of contents and at the level of expression are the cause of the complex nature of the linguistic sign. (shrink)

Purpose. The purpose of this paper is the study of gender aspects of management and relationship between management characteristic and style of leadership from gender typing in order to improve management efficiency. Theoretical basis. To understand the influence of gender mechanisms on the organization’s governance system, it turns out that there is a difference in the approach of women and men to management and leadership. The main characteristics of male and female leadership style, features in making management decisions regarding work (...) and career are given. Originality of a paper is the further development in the theory of gender processes with application of interdisciplinary approaches in studying the phenomenon of gender, not from the point of view of the interactions between two large social groups, but as a social resource of an organization where men and women represent labor potential, rational use of which is the key to successful management in the organization. The social potential of Ukrainian women can become a valuable resource in a country, a region, and any social organization. Conclusions. In modern society, the unique experience of women’s rule is ignored, indicating that they have significant and little used management potential. An analysis of gender interactions in management processes revealed the active desire of women for career growth and success in individual image. However, the transformation of the gender sphere in an organization reflects the preference of patriarchal relations, which is an obstacle to the advancement of women in the managerial structure and, accordingly, requires them to make significant efforts to achieve equal management opportunities with men. To ensure the effectiveness of the organization, it is necessary to take into account the gender factor and comply with gender balance in management positions. (shrink)

The article is devoted to Russia research Buddhism at the end of ninetieths and first half twentieths centuries in the comparativism development context in our country. It is marked in it that Russian comparative philosophy was closely connected with the oriental studies in our country. The Buddhism comparative research of that time was aimed at developing of theoretical and methodological foundation of comparative research, overcoming of European centralization and the problems of finding and understanding of common senses in different cultures, (...) finding the ways of Buddhism language «translation» into the European civilization language, determining of the Eastern Philosophy role and place in the world historical and philosophical process and proper philosophical systemand concepts substantiation. Typological similarity concept of the Eastern and Western philosophy problems proved to be theoretical and methodological foundation of comparative research in Russia. The essence of this concept is concentrated at the assurance of the system range of the Indian philosophy being the same one as the Greek-European philosophy possessing the same problems, answers and thinking laws, may be not always in the same combination andquestions but it surely being the everlasting philosophical problems of humanity. Purpose. The purpose of the study is to define the negative impact of gender inequality on the global economy and public health. Theoretical basis. Unequal treatment of individuals based on gender discrimination has led to negative consequences in various areas of society. Gender inequality is very costly for the world due to the lack of representation of women in the labor market, gender income inequality situation, glass ceiling effect that have the negative impact on the world economy. Outdated gender roles, (...) which are inconsistent with the new reality and the idea of human progress, have a significant impact on life expectancy, health, mortality and disease, access to health care and medical care. Originality. The vector of the development of the human society changes its direction, which leads to a renewal of an individual status-role framework, the creation of the new systems of values, theories and ideologies that require a new field of opportunities and free human self-identification and gender-identification. Conclusions. The results show that gender inequality has a negative impact on economic growth and development, as well as on physical and mental health. Strictly fixed gender roles limit free human development. Everyone should have the right to determine her/his gender, her/his interests and behavior patterns, while having the right to personal respect and respect for their honor, convictions, and gender practices. Purpose. The paper aims at examining the phenomenon of the rebirth of the Goddess in the contemporary world. The author has used the hermeneutic approach and cultural-historical method, as well as the anthropological integrative approach. Theoretical basis. The study is based on the ideas of Carol Christ, Margot Adler, Miriam Simos, and Jean Shinoda Bolen. Originality. The rebirth of the Goddess is not a deconstruction of the God. The face of the Goddess is one side of the binary opposition "Goddess (...) – God". Life on the earthly plane presupposes masculine and feminine dualism. However, these polarities are not mutually exclusive and mutually suppressive, but complementary to each other. The return of the Goddess to the throne and a profound appreciation of Femininity is a necessary step forward in establishing true equality and restoring lost harmony. As humanity returns to the Absolute that transcends duality, as divinity is revealed in feminine and masculine forms, and, finally, as humans get in touch with their true self, the two faces, feminine and masculine, will inevitably merge. Conclusions. Identifying herself with the images of the Goddesses, a woman develops self-awareness and self-acceptance that contribute greatly to her reintegration with a wider spiritual reality. The cult of the Goddess finds practical application in women’s lives. These are magical rituals, work with the archetypes, life-changing tours. Recognizing her right to the fullness of being, a woman overcomes rigid gender roles and stereotypes, ceases to be an object of manipulation and becomes the supreme arbiter of her own life. (shrink)

Мета. У статті зроблено спробу розглянути соціальне прогнозування крізь призму трансдисциплінарного підходу з урахуванням цілісної природи людини. Теоретичний базис. Складність соціального прогнозування полягає в тому, що воно має справу з багатовимірним феноменом людини – людини, яка є і творцем, і творінням соціальних світів, для якої всі економічні, соціальні, політичні, наукові, культурні досягнення, проблеми та перспективи набувають сенсу лише в контексті неї самої, її життя, її власної долі. Таким чином, феномен людини є ключем до розуміння динаміки сучасних трансформаційних процесів і створення (...) перспективних моделей майбутнього розвитку людської спільноти. Оскільки в процесі прогнозування ми намагаємося осягнути майбутнє, яке ще не є визначеним та може мати різні траєкторії розвитку, трансдисциплінарний підхід до прогнозування, який охоплює те, що наявне в межах дисциплін, на перетині дисциплін і поза межами всіх дисциплін, може стати найбільш плідним підходом. Наукова новизна. Людина привносить високий рівень непередбачуваності та невизначеності в усі соціальні прогнози. Сьогодні складна багатогранна природа людини як біологічної, психологічної та соціальної істоти потребує більш глибокого розуміння, що вимагає спільних зусиль представників різних наукових напрямів. Взаємозбагачуючись у межах трансдисциплінарної парадигми, представники різних наукових галузей та напрямів можуть створити свого роду путівник, покликаний формувати та пояснювати нову реальність, нове майбутнє. У такому підході на перший план має вийти не "конкуренція" теорій, методологій та протокольних рішень, а спільна мета, спільні мрії та прагнення кращого майбутнього людства. Висновки. Трансдисциплінарний підхід до соціального прогнозування має потенціал розглядати всі науки в гуманітарному контексті, зважаючи на складну багатогранну природу людини. Він виходить за рамки традиційних меж, надаючи можливість не лише синтезувати та інтегрувати варіанти розв’язання проблеми, а й височіти над нею. Трансдисциплінарність, визнаючи існування різних реальностей, забезпечує ширший погляд на світ, глибше розуміння явищ та процесів, що сприяє розробці нових проєктів кращого майбутнього людини та людства. Purpose. Without claiming to explain the meaning and purpose of the Cycladic figurines of the canonical type in the context of the culture that created them, the author attempts to investigate the phenomenon of these ancient images and their impact on contemporary humans through the lens of Carl Gustav Jung’s theory of the collective unconscious and the archetypes. Theoretical basis. The primary meanings and purposes of the Cycladic figurines are ambiguous and incomprehensible to us. We cannot understand them in the (...) context of their original culture. But we are able to create our own meanings: unfinished images generate an opportunity to bypass our conscious mind and to contact the unconscious. The Cycladic figurines may resonate with female archetypes in the male and female psyche, as well as symbolize the ontological primacy of creative unity of opposites, the integrity of consciousness and the unconscious. Originality. The author outlined the possible unconscious meanings generated by the Cycladic figurines for human psyche. The Cycladic figurines actualize the archetypes of the collective unconscious, such as the Great Mother, the Anima, and the Self. These ancient images can be used for introspection, art therapy, active imagination, meditation, mindfulness. Conclusions. The results show that the Cycladic figurines have had a huge impact on the artists of the 20 th century and continue to influence our contemporaries due to the emotional response they evoke in the unconscious, which conceals the primordial features of the ancient mind. Laconic ancient images provide a vast space of options for human imagination. In an attempt to interpret them, we are suddenly seized and carried away into unknown depths. Archetypal images are manifested in any form – from sublime and beautiful to terrible, but they create a single space full of numinous awe and beauty. Engaging with the archetypes and revealing their hidden messages, we establish a connection between consciousness and the unconscious, between the personal and collective unconscious to achieve a deep self-awareness and inner growth. Traditional document clustering algorithms consider text-based features such as unique word count, concept count, etc. to cluster documents. Meanwhile, event mining is the extraction of specific events, their related sub-events, and the associated semantic relations from documents. This work discusses an approach to event mining through clustering. The Universal Networking Language -based subgraph, a semantic representation of the document, is used as the input for clustering. Our research focuses on exploring the use of three different feature sets for event clustering (...) and comparing the approaches used for specific event mining. In our previous work, the clustering algorithm used UNL-based event semantics to represent event context for clustering. However, this approach resulted in different events with similar semantics being clustered together. Hence, instead of considering only UNL event semantics, we considered assigning additional weights to similarity between event contexts with event-related attributes such as time, place, and persons. Although we get specific events in a single cluster, sub-events related to the specific events are not necessarily in a single cluster. Therefore, to improve our cluster efficiency, connective terms between two sentences and their representation as UNL subgraphs were also considered for similarity determination. By combining UNL semantics, event-specific arguments similarity, and connective term concepts between sentences, we were able to obtain clusters for specific events and their sub-events. We have used 112 000 Tamil documents from the Forum for Information Retrieval Evaluation data corpus and achieved good results. We have also compared our approach with the previous state-of-the-art approach for Router-RCV1 corpus and achieved 30% improvements in precision. (shrink)
